In approximately 1990, I successfully appealed a Circuit Court decision that struck the plaintiff's evidence by finding contributory negligence as a matter of law. The plaintiff was a tenant and had sued the landlord for not properly repairing her back door lock. An individual entered the premises and attempted to sexually assault the plaintiff. The assailant was in a drunken stupor and the plaintiff was able to chase him from the premises. In the subsequent trial, I obtained a verdict of $50,000.
